Profit on stock taken delivery and STT paid

If a person is not having speculative gains (intra day trading) or business gains (F&O), but only gets gains from stock taken delivery the same should be treated as STCG and charged at 15% correct?

Yes capital gains will arise
1.STCG @ 15% if in previous years also shares sold were taken as capital gains and not business income.

Yes, STCG, but @ 15% only if STT paid on sale.
