Processing of original and revised return?

For AY 17-18, I had first submitted a Original Return followed by 2 revised return ITR2.

9 months down the line I received 143(1)(a) notice for mismatch of Rs 21700 (Conveyance + Tax on Employment).

I submitted by response to 143(1)(a) more than a month ago and was expecting that my Original return will be discarded and only my latest revised ITR2 will be processed after my response was submitted.

To my surprise, today my original return has been processed with a demand of Rs 3750 because the CPC is taking Chapter VIA only Rs 1,50,000 in their 143(1) calculations not the Rs 1,60,000 declared by me. It means CPC is clearly missing on Sec 80TTA which has been present in Original and Revised return. And The interest on saving account is already shown in IFOS.

Questions:

1) Can someone explain me what is going on here?

2) Can someone guide me what is to be done?

3) Why was Original return processed now? What happens to my latest revised ITR2 which should be processed? Will that ever be processed?

4) What happens to my response submitted for explanation of Rs 21700?

The reason for revised return not being processed could be that Revised return in time barred. Or the Department has already accepted the original return and started processing the same. 

 

For the Intimation u/s 143(1), if you disagree with the demand, mention you disagree with that and file a rectification request u/s 154 along with the reason. 

 

Regarding the Conveyance Allowance and Professional Tax Amount differences, the deparment processes based on the documents and evidences that they have. That is based on the Form 16 and annexure filed by the employer. In case if it is not specifically mentioned, the department doesnot allow. However, you can substantiate the claim based on the record you have. Else, request the employer to revise the TDS return and ask them to include. First, file rectification request u/s 154 within time. 

Provided that you have made the claim of Rs.21700 in your original return that has been filed.

How to file rectification request u/s 154 along with the reason? Where should I perform that step? I disagree with the Rs 3750 demand. 

Should I simply file a revised return now?

I am shocked the way the CPC Bengaluru is behaving, especially their attitude is drastically changed after DeMon.

You have to file a rectification. 

Which you can find in the incometaxefiling portal, in one of the tabs, namely "Rectfication Request"

There follow the instructions. 

missing out of 80TTA usually happens as the IFOS, is a composite figure and it does not ask for figures seperately. you can substantiate the claim throguh rectification. 

The CPC communication reference number in my 143(1) is not being accepted under eFile -> Rectififcation. It says Incorrect Details.

When I click on Response to Outstanding Demand, there are No Records. The 143(1) order does not give me a chance for rectification.

Does it take time for the Reference Number to reflect on eFiling portal?

FD Interest + Savings Account interest all was added and totalled in IFOS. What business does CPC have to remove Rs 10000 from Chapter VIA?

 

 

 

When did you receive intimation u/s 143(1) ? 

Usaully it takes a weeks time for intimation details to get updated with the incometaxefiling portal. 

How should the Rectification response be filed? How do I ensure CPC is convinced to my Sec 80TTA Rs 10,000 relief on savings account interest from all bank accounts?

On Submission of rectification, the CPC will process further and intimates you. 

Is it possible that the CPC is not believing Rs 10,000+ earning from Savings Account interest in Sec 80TTA?

In the first place, we need to know what went into the mindset of CPC in rejecting 80TTA benefit.

Missing out 80TTA could be because that Income Tax Return doesn't specifically show Income from SB interest. It is a computer processed, so there is a possibility of it being missing out. 

When the rectification portal opens, you'll find a way to file for the same. 

I called the CPC Helpline number. The call with the executive was of no use at all. I asked him why CPC removed the Sec 80TTA Rs 10,000 deduction, he said "please contact CA to know the reason", which I am already here with experts.

Executive said the helpline members have no information what was the reason in removing that deduction. Only when Rectification is filed, you disagree with demand, CPC you will reprocess the return and taxpayer will know the reason why Sec 80TTA is not applicable. Is that how taxpayers get educated with that long route?

Is any CA having any idea here on this forum "what could be the reason for CPC denying Rs 10,000 under Sec 80TTA"? Is that Sec 80TTA benefit is not applicable on a Revised return filed after Due Date?" Due date was 05-Aug-2017.

Are there specific limits or rules on Sec 80TTA in AY 2017-18?

Is TDS mandatory on savings interest to claim such benefit?

Any updates on my above queries?

Intimation by CPC is automated and computer generated, So, rectify for CPC to reprocess the case. 

But is removal of the Sec 80TTA deduction an automatic action or done by manual intervention?

My demand order date 6 Aug 2018 says demand should be fulfilled within 30 days from notice.

It is 9th day now and my CPC Communication Reference does not reflect in EFiling Portal. Hence I am not able to lodge any Rectification u/s 154. 

What do we do? Wait more?
