Procedure for obtaining Trade Mark

TM 12 has to be filed for renewing

For new trade mark : We have to file the form TM-1 alongwith trade mark as attachment.  the application is required to be submit in 6 copies. Fee is Rs. 2,500/- per form. Form is required to be submitted to respective Trade Mark Registry. After submission of application for registratin, within 15 days, we receives a copy of application back as acknowledgement/quoting of applicaiton number.  Thereafter the examination process takes place.  Now-a-days the examination report comes after 6-8 months.

For Renewal  : We have to file form TM-12 alongwith requisite fee and registration certificate in original.

I would suggest to go step by step as below:

1. Check in which class your trademark cover, is it for goods or service?

2. Prepare 3 copy of FORM TM-1 and Five representation sheet

3. If you are trademark attorney, attach FORM TM-48 and prepare cover letter

4. prepare cheque for fees and then filed it to trademark registry.

Trademark Registration is completed in four stages:

1. Application

2. Examination

3. Publication

4. Registration

i formed a shoes manufacturing parnetship firm and i want to register my product name as trademark.

pls tell me which form is filled and what is the fees where is it summitted in delhi.i don't know abt trademark.

Pls. help me for registration of trade mark. Our company is LLP & wants to apply for a  registered trade mark. Can you pls. tell me what other documents i have attached with Form TM-1 & DD in whose favour?

Is it necessary to attach a partnership deed & certificate of incorporation?

If yes, then how much copies should attach?

Also tell me whether i attached the partners Pan Card or any other identity proof?

Is it necessary to attach address proof of a company?

Within how much time should the company get the examination report & Registration Certificate?  

Pls. reply me as early as possible.

Let me try to answer your question para wise:-

Reply:- You need to attach five additional representations also.The dd will be in favour of The registrar of Trademarks payable at the Trademarks registry on the basis of jurisdiction the registry have on the bais of the principal place of your business.

Is it necessary to attach a partnership deed & certificate of incorporation?
 

Reply:- No You need not attach the partnership deed and certifcate of incorporation at the application stage.

If yes, then how much copies should attach?
Reply:- You need to attach five additional representations only with the TM-1 THREE COPIES AND A DD.

Also tell me whether i attached the partners Pan Card or any other identity proof?
Reply:- No you you need not.

Is it necessary to attach address proof of a company?
Reply:- No.

Within how much time should the company get the examination report & Registration Certificate?  
Reply:- Your LLP/Company can expect to receive the examination report in and around  six to eoght months as per the current practices, the certifcate will be issued only after your mark is accepoted for the advertisement and there is no opposition.That you can expect in two years from the date of application.

One of my client wants to register his trade mark as "LAAJO" but name "LAJO" is already registered in same class. Can he apply for the same. 

Before registering your trademark, a Trademark Search is highly recommended for the availability of your brand name. After the trademark search, Kindly find the process of Trademark Registration:

Step 1: Filing of Application, and issue of application number.
Step 2: Examination Report Issued, With or Without Objection.
Step 3: If no Objection raised- Trademark would be Registered.
Step 4: If Objection Raised- Show-cause hearing and submission of affidavits.
Step 5: Advertised in Trademark Journal.
Step 6: Not Opposed- Registration Certificate issued.
A trademark once registered can be renewed once in every 10 years.
