My client is engaged in the business of running driving school. He is providing the service of taking driving classes to College and the college is deducting TDS @ 10% u/s-94j and not under U/s  94C. Wthether he is eligible to file IT returns u/s-44AD and show the deemed profit @ 8% on gross receipts ?

Yes. but he may get notice ubder section 143 to which proper reply will have to be furnished
