27 January 2010please provide me a format of application for 154 rectification and my another query is that tds credit has not been shown in 143(1) intimationresulting in demand of tax .now i m moving 154 so do i have to submit the demand before making an application....in my case only salary income is there and refund is there on basis of tds certificat??????//

Dear Sumit,
I don't think any format is prescribed..A simple application will work.
Further, no need to deposit demand but make sure u deposit application within 30 days of receipt of intimation u/s 143(1)

thanks amir but its mentioned in the back of notice that i need to submit the demand withiin 30 days otherwise interest and penaly will be levied what does that mean

Dear Sumit,
Just because of that reason I said that the application should be submitted within 30 daysof receipt of notice of demand...
Since within 30 days u will be explaining to the AO that it is a mistake then no need to deposit demand,etc..
Further, when demamd is not correct/valid then the question of interest & penalities doesnot arise.
