Penalty for not meeting conditions

if a manufacturer producing excisable but not dutyable product is claiming exemption via conditional notification. the condition was to get an certificate from the buyer(there is only one) and submit it along with a declaration for claiming exemption, to the excise department. both the conditions are not fulfilled. what are the penalties attracted?

Maximum Penalty will be raised @ 100% and depend of the case.   

if the concern hasnt paid any excise duty thinking that excise is not applicable to them, for the past 8 years, and now if there is scrutiny, and this issue is revealed, what could possibly happen?
