Overpaid salary

The client worked in a multinational company. The company has overpaid salary to client. 2 years after the client has left the company, the company does the final settlement and asks for refund of the excess salary paid. The question is that initially when the company paid the excess salary, tax was paid on the same. Now that when the client pays the excess salary amount, how can he claim refund of tax on the excess amount paid 2 years before? Also the client is currently not a salaried person.

It's simple, while your client filling the return for current financial year just mentioned the what amount actually get after adjustment of excess salary on this financial year.
If company provides full salary as it is and deduct TDS and excess salary have to paid sepratly by cash or cheque. Than it may chances to get notice from income TAX dept.
It's better to advice your client that make a request to co that just provides me the adjusted amount.
if the client wants genuine settlement then he shall refund the excess amount of salary less tax paid by client on excess salary only if the company agree to revise its own itr.

after that..the client shall ask the company to revise its itr. if the company revise its itr, the client may also file for revision..and take the refund from department and pay back to company.
