my turnover of last year is above 1 CR. but less then 2 CR. I need to file return under 44ad but mistakenly I filed my itr in regular books in itr3 form now I get notice of 139(9) as defective return and ask me to file audit report
what should I do, can I revised return and filed it under 44ad now
please help

You have to download XML file from income tax site and fill the relavent fields and upload against the link provided for notice
You can file a revised return.
You are supposed to choose 44AD at the time of filing original return.
Later on assessee can not change from regular business income to 44AD presumptive business income by revising return. That's not permissible.
This is serious lapse on your part and now face the consequences.

Yes, you can rectify the mistake. Mention "filed in response to notice" correctly in ITR.

You can file revised return using ITR4 .
