Hi All,

I have an invoice with me wherein the subject is "Non-Comprehensive AMC (CCTV)". The Service provider is liable for Service Tax. However 12.5% VAT is charged on the whole amount. No Service Tax is charged. I have attached the Invoice. Kindly have a look at it and advice me whether the Tax applied is right or should Service Tax be applied instead of VAT. and what if it involves Service and some materials for providing the service? And what does NON COMPREHENSIVE AMC mean? Kindly answer with reference to the Invoice attached.

Dear Siddharth, On the face of it this appears to be a works contract with in the definitions under finance act and VAT act. I personally don't agree charging 100% vat on this invoice. If you are in the receiving end of this invoice kindly ensure service tax reverse charge mechanism compliance. If you are a service provider you should definitely charge service tax on this. Waiting for other experts to respond on this.
