No file the excise return

Dear Sir/ Mdam,

We have registered with central excise since 2009. We have not commerce the commercial activity on this place & also we have not file the any return to department. At now we have received notice for non-filling the return under rule 12 of Central excise act'1944. We have no plan in future for start the any commercial activity.

Pls advice what we do for resolve the matter without any penalty.

it is advisable to file nil return as you have taken registration till you start production

Once registered in Central Excise, if you have done or not done any activity, you have to file returns (if nil also) . If you not have any future plan, best you may surrender registration certificate.

Sir,

In my view that you should file the Excise Return as NIL basis, when you did applied the Excise Registration filed from till date and also surrender you Registration Certificate. Otherwise you ready for Penalty Rs. 5000.00 per Return.
