Munish bhandari book not good

People say Munish Bhandari is best..but there is not of contradictions B/w Bhandari & ICAI as well as with Bare Act

Example -

It says that Director of Public Co. wich has defaulted u/s 274(1)(g) can be appointed as a Director in a Private Ltd. CO.

Can this happen ? i m talking abt June 2011 Edition for CA FInal

yes I think poviso to sec 274(1)(g) says that that person will nt be eligible for appontment as director in any other public co it menas that he cn be appointed director of private co........

plz correct if i m wrong

yes this section applicables only to public co.

I agree with u bcoz ur views r similar to bhandari sir...let;s see wat others reply

proviso to 274(1)(g) provide that disqualification applies only to public company directorship and by interpreting bare act he can be appointed as director in publc company,

please refer bare act.

In my opinion, Such director can be appointed as director in private ltd. company as per interpretation of bare act.

As per Proviso to Sec 274(1)(g), Such Director can be appointed as director in pvt ltd co after resining or retriring from the defaulting public Co

 

no need to resign

he had to resign. Such director can't obtain fresh appointment while he is still continuing in the defaulting public Co.
