MSMED Act 2006 is now in  operation for last 10 years.  Any person who  intends to establish a medium enterprise on or after 2.10.2006 has to  file memorandum with the notified authority under the Act.   Any  person who has established scheduled industry before this date were required to file memorandum within 180 days if he had filed IEM and investment in plant & machinery exceeded Rs.1 crore but did not exceed Rs.10 crores.  For others filing of memorandum is optional.

If a firm is under SSI/NSIC reg .. and is established before 2006... it can be treated as MSME unit now. ..The firm is producing SSI /NSIC certificate and claiming to be MSME unit under MSMED act 2006.. please reply.

Hi,

In the earlier act that is interest in delayed payment one just need a SSI unit. After the repeal of the older act and as per new Act 2006 a unit needs two crtification one is a registration as SSI unit and the other is EM-2 certification to qualify as a manufacturer.
