becoz your brother is giving tax on the income to usa govt so when he is sending income to you it is only repartion & double tax is not possible on one income

 

so dont worry i is not taxable

 

& as my friends told u can show it as a loan if u will return this money in future Otherwise treat as a gift so in future u can justify income tax department also about source of income

I already provided the answer see below:


I am not showing it as anything...I specified that when we transfer money using Remit2India or ICICI Money2India services...they ask to choose the Purpose...where he choose either "Gift" or "Family Maintenance". He is getting there the Salary after deducting tax as per USA standards. He is also havinf SSN.

It s not taxable. Because that income would have been taxed in US. Again if it is taxed in India, it would lead to Double Taxation

It wont be taxable.
