Misdeclaration in import of exempted goods

Hi,

Please clariffy..

"A" imported certain goods duly exempted by a notification.

Customs/ excise authorities found some mismatch of quantity actually imported with the quantity declared under BOE during inspection of goods at the factory after clearance. 

Can the department take any action like Confiscation/ penalty etc.

My issue is that there is no revenue involvement in import of such goods. How will customs / excise authorities quantify the loss for the purpose of penalty.

Unit is an 100 % EOU.

under such circumstances the department may initiate the case of misdeclaration by importer, and ask for duty on excess quantity received, 

as the importer is eligible for quantity as per bill of import, any excess quantity is subject to conficsation.
