Mgt 14 query
a pvt company resolves to raise loan from directors exceeding there paid up capital and free reserves. a board resolution and a special resolution was also passed. i read that a pvt company is exempt from filling mgt 14 in this case. plzzzz provide the correct detail

Yes as per the exemption notification dated 5th June 2015 Pvt Co is exempted from filing form MGT-14
But in case of special resolution you have to file form MGT-14 with ROC
