Ltcg on land sale

Tax queries 477 views 1 replies

Hi Tax experts, small query

1)In case of long term capital gain tax arising out of sale of land, can we calculate the tax without indexation benefit? If yes, (if we calculate the tax without indexation benefit), what will be the tax rate?

2) If calculated without indexation benefit then will the taxable amount be added to income and taxed according to slab, or it will be a flat percentage on the LTCG calculated without indexation?

3) If we cant calculate LTCG without indexation, then will the LTCG added to income and taxed as per slab or LTCG will be taxed separately without adding to tax slab? What will be the tax rate with indexation?

Hi Abrar, there is no concept of without indexation but indexation factor is not applicable for short term capital asset. If the land is sold within 36 months then it is need not be indexed as it is a short term capital asset. Here the short term capital gain is added to income & taxed as per slab and no flat rate to be used. If  indexation is used then tax rate is 15%
