Liable for service tax..?

Hi...

I am a transporter( Transfer of Goods by Road) carrying Ice Crems in the compnies on contact basis,

Having proprietorship in Chandigarh, It is not a transport agency, means i dont any booking, i just taking the frieght charges from them.

In billing i dont charge S.T. from them, but have a S.T. Coloum. 

In F.Y. 2011-12 the total Billing was Rs. 20 Lac, I have also service tax No., Filling Nil returns,

Am I liable to pay service tax ?

If no, then can i Surrender S.T. No. ? and under what notice no. ?

Services by of trasportation of goods by road is not taxable. Except service of GTA and Courier agency

The service provided by you is very much taxable except that liability is not yours. Instead, liability is of service receiver. i would recommend you to surrender your Service tax No. it is not beneficial to you.

But under which notice no. it is not taxable.....?

In service tax department...they told me you are liable to pay service tax....if your billing is above 10 lac...and submit your balance sheet to proof it.

So I,want to give them a notice no. under which it is not taxable.

Please don't misinterpret. Your service is Taxable but liablity is not yours. You can Qoute Them N/N 25/2012 to escape from your liability
