I dont feel director will be held liable since he was not holding post of director at the time of fraud.
Yes you are right absolutely but we have to prove in front of judge so where it is written generally yes director is not liable

the director who has resigned or removed or vacated what ever be the reason , he shall be liable for the offence which occurred during his or her tenure. plz refer sec 168
