As per the recent High court judgement . Service Tax is not leviable on Rental property . We need to sign a letter of undertaking In case Demand is raised by department in future then the tenant will pay the amount unconditionally . Request you to give sample letter for the same
It should ideally be drafted by an advocate.
My attempt: We the tenants based on the Delhi High Court Ruling in reagrd to renting of Immovable property have refused to pay the service tax on the activity and undertake to pay the service tax along with interest if the activity is held to be taxable by the Supreme Court.
