Legal heir refund

Fellow club members

A client (son) whose dad passed  away in august 2017 . The deceased has been deducted TDS for the advance amount paid  for the sale of land which exceeds rs 50 lakhs . But before the sale takes place the father passed away . So the purchaser of the land has informed the seller to file income tax returns to get the refund of TDS. 

Without knowledge there client (son) has filed the income tax returns in the deceased account in October 2018 by giving the son bank account in the income tax return of deceased. ITR was processed and the refund was approved. But the refund was not given due to bank account is not the same of the deceased. 

 

Please suggest what to do next and how to claim the refund.

You use eNivaran and send one letter to AO narrating the details and request for a process to be followed to get the refund.

Sorry there is some anamoly.
e nivaran will not only solve.
the legal heir is submitting the return in his dad's account.
how can the deceased file return giving his sons babk account details.
ADHAR ,MOBILE NUMBER AND PAN ARE LINKED .

The process is go to e-filing site then log in to legal heir's log in.
And then go to my account button. Then use the last button for registration of yourself as representative legal heir and complete the process.
Once process is over, then legal heir can file return.

There is a set process for such situations.
