I am running a one person company which deals in hotel and banquet services. The hotel building is under construction.

I have made agreement with a contractor for labour employment. There is no employee employed in the company till date. And no employee would be employed till the completion of the construction. There are two contractor and both contractor employ maximum 9 labour at a time.

I want to understand whether I need to make any labor registration when there is no labor directly employed by me.

I have received an email from shramsuvidha.gov that they have automatically registered me and can do random inspection. Is there an pre preparation, i need to do.

Hi Umang,

Thanks for sharing the details. Here’s a clear explanation regarding labour law compliance and Shram Suvidha Portal in your situation:

1. Are You Required to Register If You Have No Direct Employees?

  • Since your company does not directly employ any labourers, and all labour work is outsourced to contractors, you may not be directly liable for labour registrations that apply to employers with their own employees.

  • However, as a principal employer or contractor user, you may still have certain compliance responsibilities under labour laws, especially if contractors employ more than a certain number of workers or if specific laws apply (e.g., Contract Labour Act).

2. Shram Suvidha Portal Auto-Registration

  • The government auto-registers entities on the Shram Suvidha Portal based on data received from various sources (e.g., GST, EPFO, ESIC).

  • This means even if you don’t have direct employees, the system may still register your company.

  • The auto-registration is a way for the government to monitor and enforce compliance, including random inspections.

3. What Should You Do?

  • Verify the details on Shram Suvidha Portal: Check the registered details, and make sure everything is accurate.

  • Since contractors employ labourers, ensure that the contractors have valid labour registrations and are complying with labour laws like PF, ESI, etc.

  • Maintain a proper agreement with contractors, stating that they will comply with all labour laws and bear all liabilities.

  • Keep records of contractors’ licenses, registrations, and statutory compliances handy.

  • Be prepared for inspections by maintaining records related to contractors and labour employed through them.

  • Even if you have no direct employees, you can respond promptly to any inspection notices.

4. Labour Law Registrations You May Need to Consider

  • If your contractors employ more than 20 workers, Contract Labour (Regulation & Abolition) Act registration is required (contractor’s responsibility but principal employer should ensure compliance).

  • Depending on the state and labour laws, you may need to register as a principal employer.

Summary:

Situation Action to Take
No direct employees No direct labour registrations needed
Contractors employing labour Verify contractors’ registrations & compliance
Auto-registration by Shramsuvidha Check portal details and be inspection-ready
Agreements Have clear contracts with contractors
