KKC would be applicable.

POT Rule 5 is against the section 67A  for chagability of service tax in case of new levy. Rule can't go beyond the law. It is depend on case to case basis that how much money you can spend as KKC tax on debtor or pay to professional fees to professional to prove that KKC will not be applicable on debtor existing on 31-MAY -2016

How can a law depend on case to case basis. Though I agree that its against 67A but you must have a strong backgroud to prove your case .

Yeah , So it would be better if you charge on outstandings to avoid future litigations.
