Judges not bound to disclose their wealth: CJI

NEW DELHI: With Supreme Court moving an appeal in the Delhi High Court against the CIC order on making assets of its judges public, the Chief 
Justice of India K G Balakrishnan has made it clear that the judges "are not bound to disclose" their wealth. 



"There is no statute or law which insists that the judges or the superior courts should submit declaration of their assets. Even then, our judges are submitting the declaration of assets to the Chief Justice," the CJI said. 



His remarks in an interview come close on the heels of the SupremeCourt Registry taking the unprecedented step of moving the High Court, challenging the January 6 decision of the central information commission. 



The CIC had asked the Central Public Information Officer of the apex court to furnish information within 10 days as to whether any declaration of assets has been filed by the judges of the Supreme Court or not. 



Justice Balakrishnan said he was going by the Resolution passed by the Supreme Court on May 7, 1997 which required judges of the apex court to make a declaration of their assets to the CJI. 



"It is not a public document," he said adding, that the declaration given by hiscolleagues was "based on confidence". 



"So it is not proper for me to disclose it. If it is (made) statutory, suppose if there is any Parliamentary enactment that judges should declare their assets and should give it to Chief Justice, then it is a public document," he said. 



The CJI went on to emphasize that "even then, under the RTI Act, they are not bound to disclose it. Under the RTI act, it’s a private document and personal documents are not to be revealed under the RTI act. Still there is protection." 



In his petition before the CIC, RTI applicant S C Aggarwal had challenged the denial of such information by the Supreme Court CPIO, saying that declaration relating to the assets of the judges under an in-house mechanism are "confidential". 



Any disclosure of these declarations would be breach of trust fiduciary relationship. 



Don't you think that disclosure of assets by judges would set up a moral standard? the CJI was asked. He responded by saying that any judge wanting to declare could do so as no law prohibited it. 



The CIC had held that the information cannot be categorized as personal information available with the Chief Justices in their personal category as it is available for perusal and inspection to every succeeding CJI. 



It also concluded that the institution and its head can't be considered to be two distinct public authorities and information available with the CJI must be "deemed" to be available with the Supreme Court. 



Disagreeing with the CIC's finding, the CJI contended that information on the judicial or official side can be accessed and would be given while information with the CJI has to be treated on a different footing.

Without going into the legality- into which High Court will be going in any case, i feel that judges shoud declare their assets/properties.

People of India, must know as masters of "public servants" as to how much wealth has been accumulated by its servants, in the name of public service.

this is unjust.

it should be made statutorily complusory for judges to disclose their wealth.

Shri Fali Nariman sent a two-sentence letter to the HC declining to assist High Court in the contentious matter. He also attached a document expressing his frank views opposing the stand taken by the Chief Justice of India and the SC.

I totally agree with the views of Shri Nariman.

The letter of Shri Nariman says, "That is how they earn the respect of us commoners. We in India learn by example - never by precept. For judges of the highest court to litigate as to whether or not they should disclose their assets is as bad as judges going to the court on whether it was lawful for income tax to be deducted from the salary they get! We have good judges, but we need more judicial wisdom."
 

There is no reason as to why the judges should not disclose their assets. If lack of law is the only reason, the legislature must step in. Supreme Court itself has constitutional power to legislate on its procedures- the court itself has power to make rules requiring judges to declare their assets. 

But i would like to add that it would have been more dignified, and must have served the honour of judiciary if this could have been attained without legislative interference.

We R not concerned with the JUDGE ASSETS withing this/other country,We R concerned with Pure,Timely Justice in the interest of society as a whole,whose faith shaken badly on accounts of Judiciary Failure,and Deliver Justice for 1993 Mumbai Blast after 15 yrs and Meantime give time to terrorist organisation for preparing for next attack on INDIAINC.

Praksh is right. We are concerend with justice. We are concerned with quality and timeliness of justice. And we want justice not as a largessee given by benevolent state- we want justice as our inalienable right.

This discussion establishes one thing- everybody os equal to law. More particulalry, it is for establishing that even judges are ameanble to laws like ordinary mortals. The question of timeliness of justice, quality of judicial orders will certainly be raised in course of time.
