Hi sir

There is an commission income from marketing a sum of rupees 370000 on which tds deducted under 194H , not maintaining any books of accounts , can we file ITR 3 as it's taxable under business income ,under option non maintenance of books in itr3

if it is treated as business income then ITR 3 is filed but is not treated as business then ITR 2 is filled
whether to be treated as business income or not
yes if it is fully related to business purpose
In case of commission income whether related to business or not provisions of section 44AD are not applicable .

However , benefits under section 44ADA can be obtained only if the income is professional in nature otherwise it cannot shown under option of non-maintenance of books.
