my query: our one of supplier filed March 2021 GSTR-1 in Oct 21.
we have claimed itc for March 2021 as per availability of itc at the time filing.
will be eligible to claim that itc on the December 21 return.?
please suggest 🙏

No you cannot take it now
If you have already claimed it why do you want to claim it again?
No we have not claimed itc. at the time 3 b filing the supplier not filed his gstr-1 and 3b within the due date. he filed relevant returns in October 2021
You should have taken then or in September. Now it is not allowed to claim such ITC.

itc claimed in the month of March 2021 is not valid in the eye of law as the supplier did not show such supply in his return so the recipient can not take itc of the same (only on the basis of invoice 's availability)
