Is it possible to reject a payment received?

Tax queries 146 views 5 replies

I am a doctor.  I receive professional fees from the hospital I work.  Apart from that for certain consultation services rendered a certain pharmaceutical company has given me some amount as well under section 194 J.  But after signing their agreement( a few months later actually),  to resolve certain tax issues,  I thought it was better to not accept their money.  I informed a local representative of that company(who may or may not have informed their finance depths).  In any case,  they went ahead with the payment.  Since then I have been trying to get them to take back the payment.  IE I said I would electronically return the money back and they revise their returns and not show payments in my name(so that TDS gets edited in my 26 AS as well).  But till now there has been no response from their side.  This local representative is low in hierarchy and does not have much know how regarding this.

So my query is,  how can I return the money and not show this income in my returns in a scenario like mine?

IE what to do if we get unwanted payment which is seen to push you above convenient tax limits?

Even if you return money, they will not change the TDS return as you had signed contract with them, so your tax liability remains intact!!

It is an unwanted payment regardless. Is there a process to repay that back-that is the question? What if there was no contract? (I agree there was contract... But then I asked them verbally to not pay. But I guess once made recordical these things go on in auto-pilot) Let that be... Can you give a solution if there was no contract?

Ask them to revise the TDS return, if you repay the amount. Otherwise, not fruitful.

But on repayment you will loose total amount, while tax liability cannot be more than 31.2%, so who will repay?

Not fitting in mind!!

Suppose you receive 5.0 L per year... You don't need to pay any tax But what if someone gives you rs. 10 more.... You will have to pay tax of 12500./- In that case will you reject the rs 10 or accept it? What if I realised this was going to happen and asked them not to pay me rs 10? But they still went ahead anyway?

I returned the money and the apparently has edited the TDS entry. But please clarify few things for me:

1)There is a minus entry in my 26AS. I presume, it corresponds to the amount i returned. But the date is still August 2018(the day they have given me the payment is also the exact same date. They have shown the minus figure also on this date). I have however returned the amount only recently. But the minus figure is dated August 2018. Is that a problem or is it OK?

2)In my 26AS, in the section pertaining to the TDS from this company its shown as rupees zero is given-thats good!  But nder the "remarks" subheading they have noted the minus entry with a "B" remark! What does that mean?
