Intimation u/s 143(1) due to wrong date of birth

Hi,

 

I was trying to submit my ITR for AY 11-12 after submitting it i realized that accidently i filled wrong date of birth on it.After submitting i received one mail of Receipt of ITRV.but after few days i received another mail that if for Intimation U/S 143(1). and i know i am receiving it because of that wrong DOB. can any body suggest me that what should i do.how should i resubmit my ITR.i know that i can download xml file that was submitted by me on onlineefilling website.please suggest me that what should i do and what is the process of solution for this problem.

- when you had realized it, then you was not supposed to send ITRV, but to revise the same, if the return was submited in due time, or without sending the ITR V, submit manual return to ITO.

so both the incidents was done willingly by you, as you have submitted ITR V of wrong birth date .

till now you have not mentioned that what is exact prob due to wrong birthdate?

I think i was wrongly explained my problem.Let me clear one think that i had no idea about ITR that was my first experience and after submitting my ITR i realised that my DOB was wrong,i did't do that intentionally and through this blog/forum i want to know that what should i do,because i have received Intimation U/S 143(1).so let me explain  you again that  i received Intimation U/S 143(1) and i know that it is due to wrong DOB (filled by mistake not intentionally) now my question is that what should i do if any body received this intimation?

intimation 143(1) is nothing but just a calculation sheet, in continuation of your return filed, if there is any refund / tax due, department informs you regarding the same, with correct calculation,  if there is no demand or refund, as stated in 143(1), then file the same in your records and sleep in peace. :)

Please do not worry as everyone receives intimation u/s 143(1). It is not because you have mentioned wrong date of birth.

This Intimation u/s 143(1) should be treated as completion of assessment income tax returns for the year unless there is tax due from the tax payer.

We treat this as Intimation of completion of assessment of income tax returns, Intimation of Income tax refund in case refund is due from income tax, India. If net taxable income is more than total tax paid, this Intimation u/s 143(1) will be treated as demand notice for payment of income tax due to income tax department.

 

Thus check the details mentioned in the intimation. Just check if there is any refund/demand. If there is nothing than Just chill :)

Thanks Mr. Jain for your reply,i am delighted with your answer,I have one more question as you mentioned in your answer " check the details mentioned in the intimation" i checked that intimation but there is nothing mention in that intimation.do you have any experience or idea about this intimation 143

Hi Alok,

Intimation u/s 143(1) shows 2 columns - The first column shows the calculations made by the Department and the second one shows the calculations done by you at the time of filing your return.
You just need to verify your calculations with that of the department. And check if there are any differences

Mr. Jain,

There is no difference in those columns or calculation of those columns.but in notes section of that intimation 7th point is 

 

Variance in the computation of tax can be generally attributable to:
- Difference in Gender status between the PAN database and the ITR filed
- Difference in Date of Birth - for Senior Citizens between the PAN database and the ITR filed
- Difference in Residential Status between the PAN database and the ITR Filed
The solution for rectifying this is to update the PAN Data appropriately and then filing for a rectification
 
and i am sure that my DOB is wrong so can u suggest me now that what should i do.

if wrong DOB implies you any additional tax liability, then file rectificastion u/s 154

if no liability is there due to this mistake in DOB, then forget the same and file the intimation of 143(1) in your records and stay in peace.

onwards check carefully the data and calculation before filing.
