Hi Friends,

During the course of my audit of many companies i have come accross a common problem while calculating the taxable income of the companies for making provision for taxation that is there is interest on late deposit of advance tax, tax deduction at source and service tax. Whether such interest on late deposit of statutory dues is allowable expenditure under the income tax act. Please refer the section also while sending the reply and send me the reply as soon as possilbe.

Income Tax Interest and TDS Interest are not allowable expenditure. But Sales tax, Service tax and other interests which are incidental to the business the same is an allowable expenditure. Any penalty paid regarding those issues is not an allowable expenditure.
Interest on income tax is also income tax ....hence the same is not allowable
No LAte PAyments/ Penalties are allowable Expenses
no, any penalty or interest on statutory dues under any law is not allowable in IT act
As it is specifically mentioned any penalty or interest by any act is not a permissable deduction hence, in your capacity as a good practisioner you can disallow that expenditure
no interest will be allowed for any exemption but it is to be mention in tax audit
interest on income tax is not an allowable expense...
please tell me whehter interest on late deposit of service tax is allowable or not. Reply as soon as possible
no way this expenditures are not allowed while computing the income.
