Interest

Pls let me know about this.

I was supposed to pay service tax on 5th the due date for payment. I am also suppose to make payment through e_payment route.

? The designated bank through which i make payment its (the Bank) server were down or some problem with their net banking web. I that case it was impossible to me to pay my service tax due on that date, and it continued till 9th of this month. I paid it on 9th at 3.50pm. In that case whether I am liable to pay interest for delayed payment for no fault of mine which is due to failure of the banks systems.

I there any clarification on this matter.

If I could be reffered to any case law & notification regarding this.

Thank everyone

This is quite similar to that in the case of sudden banking strike and it remains close for a few days. The assessee is required to immediately inform the Authority ( on 5th ) and also submit the proof that had the server not down the payment would have cleared and it has sufficient balance in the account. Then interst liabillity would not have arisen
Thank you kaushal, But We have two A/c, One dedicated to e_payment in which we usually don't keep balance, and the other one from which usually we transfer funds to e_payment A/c has very heavy balance. In that case what would be the effect. I have made ST payment without paying interest. will i be liable for default. Really urgent. Thank you. CA.Viru Tuppad
