following is the announcement dated 1st july 2009 by institute reg articleship. give your thoughts on it.

Transfer/Termination of Articleship - (01-07-2009)

Transfer/Termination of Articleship
[Regulation 56(1)]

In accordance with the decision of the Council, the transfer/termination of articleship in terms of Regulation 56(1) of the Chartered Accountants Regulations, 1988 shall be permissible to an articled assistant on satisfying any one or more of the conditions as stated below: -

Medical grounds requiring discontinuance of articles for a minimum period of three months (on production of a Medical Certificate issued by a Government Hospital).
Transfer of a working parent to another city involving a distance of minimum 50 kms (on production of a certified copy of the transfer order and the proof of relocation to another City).
Misconduct involving moral turpitude.
Other justifiable circumstances / reasons: -
- Grounds already permissible in the Chartered Accountants Regulations, 1988 (on submission of requisite proof of the act warranting transfer/termination of articleship): -
  - Industrial Training (Regulation 51)
  - Secondment of articles (Regulation 54)
  - Conversion from PCC to IPCC (for termination of articles only. Re-registration of articles to be allowed only after passing Group-I of IPCC)
  - Death of Principal [Regulation 57(1)(c)]
  - Ceasing of practice by the Principal [Regulation 57(1)(a)]
  - Removal of name of the Principal from the Register of Member due to any reason [Regulation 57(1)(b)]
- Marriage basis (only if there is relocation to another city involving distance of 50 kms).
- Irregular payment or non payment of stipend with reference to Regulation 67.
- Articled assistant desires to serve balance period of training outside India.
- Shifting by the Principal to another city involving distance more than 50 kms.

The articled assistants are required, in the first instance, to get the consent of the Institute before getting Form 109 signed by the Principal, in their own interest.

The request, on any one or more of the aforesaid grounds, of an articled assistant on a plain paper with recommendations of the Principal for transfer / termination of articleship accompanied by evidence/proof (self-attested by the articled assistant) to the satisfaction of the Institute be made.

No change at all.

They just elaborated the earlier provisions.

Less Exposure should also be allowed as an justifiable reason for transfer.

no rules are made in favour of articles. nothing is mentioned about transfer

Im reminded of one book by name Peter's Principle written by Dr.Laurence J.Peter.Currently ICAI is suffering from incompetence at the highest levels of the organization.

Peter's principle includes such Redtapism, announcements which confuse and confound one and all, non-transperent ways of working,highly illogical stance adopted at the behest of promoting incompetence,etc.

Unless, ICAI beats this Peter's principle (of incompetence) at work it has no hope of staying as the primier Accounting body of the company.Peter's principle when taken to extreme levels bring in atrophy to the organization.

I do urge students atleast to buy these 2 books and make a diligent study of it, for it does improve one's thinking and lifestyle.

Maybe this should be taught to all Government breaurecrats

Thank you for recommending the books.

I have experience of all the things you mentioned about ICAI in various posts. Your knowledge about the insane, immature and sick thinking and behaviour of ICAI and many of its members is commendable.

Uttamji calls CA a pariwar but fails to understand that CA students are the children of this pariwar and in a big way he and all others at ICAI have shown ignorance of how to behave with children of this so called pariwar.

That is why yesterday I had urged all students to observe a mourn day.

This is shocking and i was expecting that nothing would change in the benefit of CA students. esp the a**h**e person who was telling that ICAI is gonna allow at least one more transfer.

Among all this reasons which Uttam considers legitimate; i feel if any of you guys and gals feel like leaving your sh*tlike principal(if they are like that); MARRY AND TAKE TRANSFER AND THEN DIVORCE, HAHAHAHHa.

ICAI's top men have no brains or are they pretending to be having one. What's this. 2 months ago; he says he is forming a commiittee to list down legitimate reasons for transfer. Now, the commiittee is formed; they waste ICAI's funds (our fees); laze around and add 2 more points. and that's it.

THIS IS BLACK DAY FOR ALL CA STUDENTS.

And what about taking prior consent of taking permission/advice from ICAI before signing Form 109.

a)If through any source the present CA comes to know that ye bunda transfer lenaa chahtaa hain; he might use his unprecedented power given by ICAI to make his articleship nil citing all those foolish exploitable reasons like moral turpitude(seeing girl articles in office, may be)

b) We all know how paper work is FAST in our ICAI. 2-3 mainaa to aaram se lagg jaati hain. Then by that time; if the person who was gonna take us under him finds another article; the student will be left nowhere to go.

Very poor. Our Institute is not taking any scientific steps to handle the students affairs.....The step which they have taken currently to regulate dummy in not practical....A dummy always finds steps to tackle the ICAI...but it is only the regular articled trainee suffering

vey true mostly dummies are relatives of CA ....actually this step is taken to allow the CA's (so called principles) to torture their articles ....as they have no chance to escpe and are left with no choice but to bear it.
