Indexation benefit in ltcl

I wanted to know when there is long term capital loss on sale of unlisted shares, indexation benefit is available on same while computing such loss ??

For eg 

Mr. X is having 50000 Equity shares @ Rs.10/- on 01/04/2000 in ABC Ltd which is unlisted company.

And he sale the same on 10/12/2014 @ Rs.3/- per share

So Computation will be as follows.

                              FVOC                         Rs.1,50,000/-      (50000 SH*Rs.3/-)

                 Less      ICOA                          Rs. 12,61,000/-  (10*(1024/406)*50000)

                        LTCL                           (Rs.11,11,000  )

 

Pls let me kno whether above computation is correct & can it b taken as a set off agains long term capital gain of sale of Shares of XYZ Ltd (unlisted company) Rs.20,00,000/- ???

Yes it is possible and you have rightly computed the capital loss which can be set off with ltcg.

Thanks for your revert... i would like to know when its share of unlisted company any particular provision or any specific point to be taken care of....?

In case of unlisted equity shares from financial year 2014-15 period of holding should be more than 3 years then only it would be a long term capital assets otherwise it would be short term capital assets.

Another point not pertaining to income tax please pay applicable stamp duty on transfer of shares.

 

You have to pay CG at 20% after taking indexation benefit and 10% without indexation benefit.

I think no need to give extra reply there is proper answer.. if u have further any querry plz ask.. :)

This option of choosing between 20% on indexed long-term capital gains or 10% of unindexed capital gains is available only in case of only listed shares which are transacted outside stock exchange.

In case the shares sold are not listed in India, this option of choosing between 10% unindexed and 20% indexed capital gains is not available & tax rate is straight  20% indexed.

when there is transfer of shares of unlisted company say X which result into LTCG & another tranfer of shraes of unlisted company say Y which result into LTCL. this LTCL of Y is setoff against LTCG of X.

Pls let me know procedure to transfer shares of Unlisted Company.

and most important is what documents to be given as a proof of transfer of shares of unlisted company when demanded by some one or say Assessing officer .
