Incorrect use of ITR form

Dear Sir/Madam,

I am individual taxpayer working in a private sector. I used form 281 to taxes for AY2008 instead of 280. Quoted employer TAN in 281. IT sent arrear demand notice in 2011,Since the paid tax was not credited to my PAN account.  I sent request letter to AO in 2012 to transfer the tax paid from employer TAN and credit to my PAN account. But it was not done. Still there is demand uploaded in my account. Could you please help how to resolve this issue?  OR Should I pay outstanding arrear demand now( including accumulated interest?

Regards

Ramamurthy

Quick Summary
An individual taxpayer mistakenly used Form 281 instead of Form 280 for AY2008, quoting their employer's TAN. Despite attempts to rectify the error by requesting the tax be credited to their PAN, the issue persisted, leading to an arrear demand notice. The discussion explores various solutions, including using the CPGRAMS grievance portal and contacting the employer for a refund, ultimately concluding with the taxpayer paying the outstanding demand online.

They won't reply , do they deducted any money from your refund in past. To avoid any deduction pay exact tax in future. In my case 2005 I paid tax after filling return , after visiting twice to AO in 2013 they not corrected.

File CP GRAM, Address the department and submit all the documents previously submitted

advise how? CP GRAM, Address the department

Yes registered with cpgrams and booked grievance, now under process  and file is with IT officer at BKC bandra mumbai.

Thanks for advise

In cp grams only one document can be uploaded.

Merge the docs you want to upload

Yes. Submitted the grievance in CPGRAMS on 27 June 2021. But the file is still with principal commissioner of income tax. It did not go to concerned officer.

Thanks for advice

Hello Jagdish,

No reply yet after 3 reminders

Ok. What would be next step?

Should I pay outstanding demand uploaded on internet? Or wait for some time .

Thanks

Just an informal way as last resort

You can ask Your Employer to claim the refund of the TDS Amount paid By you, if its still unused by the employer. Even if its used by the employer, its paid by you as per the accounts and no one can deny that fact.

Then Claim that amount from the employer to pay the income tax arrears

Thank you Misha Vidhani.

Today I paid the outstanding demand online and shared the challan with employer.

Paid the outstanding demand because employer did not respond even with multiple remainders.

Thanks

now my file moved AO Mumbai to Banglore Dr. Sibichen K Mathew Director of Income Tax cit.cpc.bangalore @ incometax.gov.in looks gone for correction as the tax was paid in the same year challan submitted.
