My colleague expired on 16th Jan 2014 & got salary of approx. Rs 13 lacs till 16 th Jan. Now his wife is getting approx. Rs 14 lacs under death relief scheme in which all employees of co. contribute Rs 50 from their salary . Now who will file ITR for my colleague,his wife ? If so ,whether total taxable amount will be Rs 27 lacs ?

In my opinion,The first 13Lakhs will be subjected to Income tax under your demised colleague status under the head "Income from salaries" and what ever his wife received will be taxable in her hands as "Income from other sources".Because if first 13 lakhs taxable in her hands it is in the nature of "Income from other sources" but really it is nature of "Salaries".so my above assertion may be valid in this concern
