person is providing the cable TV / internet services in own localities and paying fix licence fees to the main cable TV signal provider.... weather this person can file return u/s 44AD...??

Gymnasium/fitness center can file. But person providing cable if it is an agency service for which commission received say after deducting tax u/s 194 H then 44 AD can't be opted.
