Income tax rent claim

My father and his brothers have built individual house on the land which belongs to their father(my grandfather). My grandfather has expired and not left behind any will related to the land distribution. But my father and his brothers have good relation. Each one has own electricity and telephone connection on their Name for their house. But the house which is built is still not on their Name. Now I am planning to claim tax rebate on the rental component. Can I claim I am paying rent to my father and declare it in the income tax filing? What documents would be needed by my father to prove house belongs to his name(as the land on which it is built is still on my grandfather's name)
