I am an Asstt. Engineer in a state Govt. owned Thermal Power Station.  In AY 2011-12, with the help of a friend I e-filed  my income tax return (online return). I have only salary  income of Rs.7,90,387.00. but while filing my return, a mistake happened and a more zero was placed in my Income making it 10times more. it revealed only after submitting the same.

I sent a letter explaining this mistake with a copy of Form-16(issued by my employer) & a filled in revised return form in physical to CPC, Bangalore  by general post. 

I did not heared there-after. suddenely a month ago in Dec'2012 I got a notice from Income tax officer-Bokaro to appear before them and deposit Rs.24Lac as Incometax  which is long due against my PAN no.

I contacted a local IT Advocate, now he demands approx Rs.20,000/-+ to get it resolved. Otherwise I may fall in problem & have to deposit the due.

It may be noted all my sources/deposits/PF/ can not fetch the such a huge amount.

I am in a big problem & see with hope for any suggestion what I do now.

Hi Ashok,

original return filed by you was in physical or online? On the basis of that remedy will be easier.

Dear Ashokji ,

You must have recd Notice U/s 143 (2). If it is so then you have to visit IT dept. What i suggest is if it is the genuine mistake from your end and you have shown all the facts and figures in the return ( means if IT dept. goes in details they should find all the things which you have shown , there should not be any other undisclosed income ) do co-operate him. If you are right , you have not done any thing wrong then no one can put you in trouble. Do visit office of good CA. He will help you out.

As you have filed the original return electronically, you should immediately revise the return electronically (if you have filed the return on or before due date) and submit the copy of the same alongwith your responce to IT department.

If u have filled the revised return within due date...then ur original return vll b vanished as per case law of dharampur sugar or sagar somethng like dat...so if u filled the revised return  within due date... ur revised return vll be treated as original return... u need not to be scared...just collect all the document and go on hearing with A.O........

Physical return has to be filed to the local Income Tax Office. Since revised return has not been filed to local Income Tax Office and has sent to CPC Bangalore it may not be valid and acknowledgement for the same may not be avaiable. Therefore revised return has to be filed again electronically.

It's quite simple. As long as you are having Form 16, you can  submit revised return electronically. Or otherwise visit to Local IT office and meet ITO (Income Tax Officer for salary ward) . They will surely help you

 

your correct salary is 791383 which is already mentioned in form 16 issued by your employer.so u can revised ur return .and revised return steps in the shooes of original return.so dont worry

Dear All ,

If anyone has recd notice u/s 143(2) / 144 , he can not revise return. It is mandatory on the part of the assessee. It is not at all advisible to revise return.

I think he should have not received the notice u/s 143(2) but it should be intimation u/s 143(1) or demand notice u/s 156. Even though if he has received the notice u/s 143(2), he may revise the return until the completion of the assessment.
