Income of cable tv operators

Hi,

I have a following queries. 

a) Whether a cable TV operator income comes under the purview of sec 44AD?

b) if so whether we can declare the income per 44AD even if the net income is higher (for eg., the gross receipt is 12L and the net income is Rs. 4L tentatively (books of accounts not maintained) but the amount calculated per 44AD is only Rs. 0.96L) or is it mandatory to shows the actual net income.

Cable TV operator is in the form of Commission. pl confirm is there any TDS on your income ? If commission then no 44AD. Regular ITR3 with books of accounts.

The income earned by the cable operator is of service charges collected directly from the subscribers. There is no TDS so far in any of the years (current or previous) so far.

As service charges cable operator can opt for 44AD. Minimum profit is 8% on 12 lakhs service charges only becomes 0.96L but if actual is more than declare that as profit.
