Import duty clarification

We are Importers of Paints which are under UN 32089011 & for all the stock we import, we are paying the duty which is like below :

 

Basic Duty  - 10%CE

CVD  - 12%

Education Cess - 3% 0n ( Basic Duty + CVD + CE Edu Cess )

Additional Duty Imports  - 4 %

 

We are not manufacturers, if so what can be claimed on the paid duties in cenvat. can we get this refund back ?

2/  If we sell the goods to manufacturers on High Sea Sale,. what is the portion of duties they will be benefited?

i dont know about more infomation about this. but you can claim the additional 4% duty as sad refund process

Well I don't have much knowledge of Cenvat refund but I can tell you that,

In case of High Sea Sales the Goods are sold outside the Indian Territory, so when you enter into HSS Agreement the all the custom benefit would be forwarded to the HSS Buyer and he can claim all the benefits available from Custom as per his Country's Laws.

Also since you are not manufacturers and mere traders of good, if you import the same and sell it to others and fulfill the SAD formalities you can claim refund of 4% Special Additional Duty paid at the time of Import.

If import any goods like bike r car what ill duty of tax ?
