(1) No export or import shall be made by any person without an Importer Exporter Code (IEC) Number unless specifically exempted. An Importer/Exporter Code (IEC) number shall be granted on application to the competent authority. 

(2) An application for grant of IEC number shall be made by the Registered/Head Office of the applicant to the licensing authority concerned in the form specified and shall be accompanied by documents prescribed therein. 

(3) An Import Export Code No allotted to an applicant shall be valid for all its branches/divisions/units/factories as indicated on the IEC number.

(4) Where an IEC Code/ Import Export Code No is lost or misplaced, the issuing authority may consider requests for grant of a duplicate copy of IEC number, if accompanies by an affidavit.

(5) If an IEC holder does not wish to operate the allotted IEC number, he may surrender the same by informing the issuing authority. On receipt of such intimation, the issuing authority shall immediately inform all the RBI/Customs/Licensing authorities that the said IEC number has become inoperative. 

(6) If there is any change in the name/address or constitution of IEC holder/licensee/Actual User eligible for import without a licence/recognised status holders, as the case may be, shall cease to be eligible to import or export against the licence/IEC Number or any other facility permitted under the Policy and Handbook, after expiry of 60 days from the date of such change in his name or constitution, unless in the meantime,

a.        the IEC holder/licensee/status holders has got the consequential changes effected in the IEC number/licence or the recognition certificate, as the case may be, by the concerned licensing authority.

b.        the Actual User has got the consequential changes effected from the concerned authority in the Industrial Licence issued by the Secretariat for Industrial Assistance (Ministry of Commerce and Industry) or Certificate of Registration as an Actual User issued by Director of Industries of the State Government or has received an acknowledgement for filing of a memorandum with the Secretariat for Industrial Assistance. Provided, however, the licensing authority issuing the IE Code may, condone the delay on payment of a penalty of Rs.5000/-.

HOW TO APPLY FOR THE ALLOTMENT OF IEC NUMBER:-

      

            A business firm should submit the following documents to the regional licensing authority having jurisdiction over the firm for the allotment of Importer-Exporter code number.

1) An application must be made in the Aayaat Niryaat Form 2A (ANF 2A) format to the Regional Authority of the (Directorate General of Foreign Trade) in the regional office of the DGFT where registered office of the company /pace of business is situated in duplicate.

2)Bank draft for an amount of Rs.250 drawn in favour of Regional licensing authority towards the payment of fee for the allotment of IEC number.

3)Certificate from the banker of the applicant in the format given in

  Appendix 18A.

4)Part D in respect to Declaration/undertaking has to be filled in and signed by the applicant has to be submitted along with the application.

5) Profile for Exporter/Importer in the form ANF 1.

6)Three passport size photographs of the applicant. (Two of them to be duly attested by the banker of t he applicant and affixed on the application form).

7)  Prescribed declaration on the firm’s/company letterhead stating that:

 

                  I/We hereby declare that there is no non-resident interest in my/our firm/company.

                 I/We further declare that the proprietor/partner/director of my firm/company is/are not associated as proprietor/partner/director with any other firm/company which has been caution listed by the Reserve Bank of India.

                  I/We further declare that the proprietor/partner/director of my firm/company is /are not associated as proprietor/partner/director with any other firm/company which has come to the adverse notice of the DGFT.

8) In detail list of documents required for firm/company for getting IEC number.<--[click]

9) Copy of the letter indicating the allotment of the Permanent Account Number of the income-tax.

10)  Authority letter from the partners of the firm authorizing a partner to sign the application for allotment of IEC number in case the applicant is a partnership firm.

11) Resolution of the Board of directors authorizing one of the directors to sign the application for allotment of the IEC number in case applicant is a partnership firm.

12) Resolution of the Board of directors authorizing one of the director to sign the application for allotment of IEC number in case of a private limited or public limited company.

 

         The Regional Licensing authority shall examine the application and if it is satisfied it would allot the IEC number to the applicant.

IEC NUMBER IS LOST OR MISPLACED:-

                       Where an IEC number is lost or misplaced , issuing authority may consider requests for grant of a duplicate copy of IEC number , if accompanied by following documents:

1) Request letter on letterhead for issue of Duplicate IEC number.

2)Application form as per Appendix 2 and 3 in duplicate.

3)Copy of IEC or IEC number.

4)Copy of FIR.

5)Affadavit on Rs.20/- stamp paper duly notorised.

6)Challan or DD of Rs.200 in favour of jt.D.G.F.T.

7)Self Addressed envelope affixed Rs.25/- postal stamp

IEC No: Exempted Categories

 

The following categories of importers or exporters are exempted from obtaining Importer - Exporter Code (IEC) number:

    1. Importers covered by clause 3 (1) [except sub-clauses (e) and (l)] and exporters covered by clause 3(2) [except sub-clauses (i) and (k)] of the Foreign Trade (Exemption from application of Rules in certain cases) Order, 1993.

    2. Ministries/Departments of the Central or State Government.

    3. Persons importing or exporting goods for personal use not connected with trade or manufacture or agriculture.

    4. Persons importing/exporting goods from/to Nepal provided the CIF value of a single consignment does not exceed Indian Rs.25,000.

    5. Persons importing/exporting goods from/to Myanmar through Indo-Myanmar border areas provided the CIF value of a single consignment does not exceed Indian Rs.25,000. 

      However, the exemption from obtaining Importer-Exporter Code (IEC) number shall not be applicable for the export of Special Chemicals, Organisms, Materials, Equipments and Technologies (SCOMET) as listed in Appendix- 3, Schedule 2 of the ITC(HS) except in the case of exports by category(ii) above.

    6. The following permanent IEC numbers shall be used by the categories of importers/ exporters mentioned against them for import/ export purposes..
