A new client came to my office and I found that no GST is paid by the client. But as per Income tax data some payments are reflected. Now lindly direct me how I can correct his data because all the GSTR from last 4 years have been filed.

GST tax should be paid through DRC 03 with interest.

Ok, but he has enough ITC for Tax, Is Interest applicable? Can I also file Annual return first and than tax through DRC-03?

Interest if ITC not utilized in terms of Rule 88B but penal provisions may attract under section 73.

@ Mr. SHIV KUMAR,

If the client can't paid GST liability then GSTR-3B filing is not possible.

So, ask Your query with correct details.
