Dear Experts,

We are an Indian merchant exporter and are exporting a consignment to Kenya buyer.

Product HS Code (Followed in India) - 392010.11

Product HS Code (Followed in Kenya) - 392010.10

The buyer in Kenya is insisting on following their HS Code. How can we resolve this matter? Please advise. Thank you.

Use your own code for clearance from factory, remember its not HS Code but ITC code, for excise, and at the time of making export documents for customs, use the HS code provided by byuyer in Letter of Credit.

or use both HS code as

indian HS Code

Kenya HS Code

as sub head 10 is not used in india, you can feel heat to clear the documents from customs. however you can ask your CHA to discuss the issue with customs superintendent, if he allow then you can make documents as per kenya HS code.

Thank you for the reply. I have spoken with CHA, he will submit custom invoice wid our hs code whereas buyer commercial invoice will have Kenya HS code. I just hope that excise people do nott create problems while issuing CT1.
