I think you can avail HRA exemption here, provided you write a letter to the company stating that the flat is owned by your wife and rent is paid to her, and duly attested by the society.

Let others reply.

Dear all

HRA is not availabe on house rent paid to wife.

in such a case how much exemption is avaialble or is it that no exemption can be taken. In such case would it be correct not to take HRA from company and make it a leased accomodation in name of my wife directly ?

Since the property is jointly owned by the husband, the question of giving rent is very doubtful, as he himself is a partial owner...

If the person owns a houseproperty but can not live in it due to employment reasons and hence pays rent, then it can be allowed....

Hence, both the above cases are against the husband and he can not get the benefit of exemption under Sec.10(13A)....
