How to claim refund if tds was deducted

Hi,

How to claim refund of tds which was deducted on salary, actually the person is exempted from paying income tax as per Sec.10(26) of Income Tax Act and there is no option in either IRT form for claiming Refund for the Same.

If your Salary is below from the maximum amount not chargeable to tax,refund can be claimed by filing ITR-1.

 

TDS was deducted by Employer and the above limit is also crossed

File ITR-1 for claiming Refund of Tds already deducted.

In ITR-1 there is no option of showing income exempt from tax u/s 10(26), yes there is a option of showing exempt income but this is only for reporting purpose.

for example if salary income is 370000 and if we entered this amount in salary account then this will calculate amount that is tax payable not refund. suppose TDS is 5000  

This is one of the greatest flaw of CPC which does not process a return if no income is offered but TDS is claimed.
You can do one thing. File the return with zero salary income. Report the exempt salary as required. Claim the TDS. If the return is processed then it's all right. If you receive any defective notice then just file a reply that it is not a defect.
I have talked about the issue with one expert. He advised me to fill the Daley amount as zero, report the exempt amount as required and also to fill zero in schedule TDS as Income from salary. Claim the TDS and you will get the refund

No, my salary is abt 5 lakh something and my employer already deduct TDS
