In this case deemed owner rule applicable or not . If not then why.
no not applicable as you are not the owner
an individual who transfers otherwise than for adequate consideration any house property to his or her spouse, not being a transfer in connection with an agreement to live apart, or to a minor child not being a married daughter, shall be deemed to be the owner of the house property so transferred And why clubbing of income provision not applicable in this case Please describe with rules or section
in this case you are not the owner.vthe above provisions applicable only if you are the owner of house property
In this wife is owner without earning and husband paid emi then which provision applicable Thanku very much sir
And if husband paid emi then as per he shall be deemed owner
deemed owner means you are initially the owner of house property and when you transfer the property to your spouse without consideration then in that case you are still the deemed owner.
but you are firstly not the owner of the property so deemed owner concept is not applicable to you
get the property regusuin your name as deemed owner
And clubbing of income provision why no apply
Thank u very much Ok
