Home loan tax benefit after possession

Hi Everyone,
 
I need to know how to calculate tax benefit for my home. My home loan started in Dec 2009 and I took possession in July 2010. Home was put on rent from July 2010 onwards. I was out of India from Dec 2009 till Oct 2013 and never claimed any tax benefit for home loan. My only income in India was rent 10K PM (1.2L Per Year) so I did not file IT return since last 2 years.
 
I moved to India in Oct 2013 and staying in my own home since then. In financial year 2013-2014, my home was rented for 5 months, vacant for 2 months and self occupied for 5 months. Now I need to know:
 
1. I paid 52K as interest and 1.6Lakh as principal 2013-2014. I should be able to claim that under section 80C & 24B even though house was rented for 5 months. Please confirm.
 
2. I paid society maintenance of 23K, can i claim any benefit for that ?
 
3A. Can i claim any tax benefit for the principal or interest paid during from July 2010 till Oct 2013 (after possession). If Yes, then how much I can claim this year and how much can be carry forwarded to next year.
 
3B. I assume we can claim the interest paid before possession (Dec 2009 to June 2010) for next 5 years in 5 equal installments. As I have not claimed anything in last 3 years, can I claim half amount this year and half next year ?
 
4. My wife is a house wife and co-owner of house but entire EMI is paid from my account. Can i claim the entire home loan tax benefit by myself but only show the 50% rent income on my name and rest 50% on her name. I can save same tax if this is allowed to do.
 
It would be of great help if someone can guide me here. Please let me know if any more information is required.

1. you can claim whole of intt and principal paid during FY 13-14.
2. no benefit..... 3. i dont remember any such prov. said by you, wait for someone else to reply on this topic..... 4. yes you can claim 100% deduction.

Thanks for your reply. For 3B, please let me know if I can claim at least 1/5 of interest paid before possession. I think it is allowed.

Though not sure, if I can claim 50%, may be someone else can help here.

According to the Income-tax Act, 1961, where the property has been acquired or constructed with borrowed capital, the interest payable on such capital for the period prior to the year in which the property has been acquired shall be allowed as deduction in five equal instalments beginning from the year in which the property is acquired. Thus, the interest included in the loan instalment paid by you during the construction period shall be eligible for deduction from the year in which the flat is acquired/construction is completed. The principal amount of the loan repaid till date shall not be available as a deduction under section 80C till the time the construction of the flat gets completed. Once the flat is completed and the possession is handed over to you, you will be eligible to claim deduction for interest paid on the loan under section 24(b) and principal amount of loan under section 80C. The total amount of deduction available under section 80C shall be limited to Rs. 1 lakh. Thus, as of now, you are not eligible for any tax benefit on such loan repayments.
