Quick Summary
This discussion clarifies whether input tax credit (ITC) can be claimed on invoices where the supplier has filed their GSTR-1 but not their GSTR-3B. The consensus is that you can still claim the ITC, provided other conditions under Section 16(2) are met. The government will pursue the supplier for the unpaid tax, as filing GSTR-1 signifies their acceptance of liability.

Which period this one...?
Yes you can

Mr Abhishek, Rule 36(4) does not stop you from availing the credit and hence you could avail the credit on fulfillment of other conditions of Section 16(2). The government would recover the tax from the supplier as uploading in GSTR-1 would mean that the supplier has accepted his liability.

What if supplier has not filed even in gstr 1 can I claim?
