GST registration for a freelancer working from home

I'm a freelancer working from home and I'm in the process of registering for GST. In a previous thread I was adviced that I can use my home address for registration as long as I can also provide a NOC.

The problem is that I approached my landlord and he says that he cannot give the NOC as giving NOC would mean that his house will be treated as a business and the electricity and water charges would be charged at a commercial rate.

So here are my questions:

1. Is it true that if you register GST by giving home address, the home will be treated as a business and the electricity and water charges will be charged at a commercial rate?

2. What option do I have now? Do I have to go ahead and book an office space which I won't even be using just for the sake of GST registration? 

I checked out virtual office spaces but it seems very confusing. I'm not even able to understand their business model. And it seems you need a registered name in order to use these services.

Any help would be highly appreciated.

  1. It is not necessarily true that if you register for GST using your home address, your home will be treated as a business and electricity and water charges will be charged at a commercial rate. However, it is possible that this may be a requirement of your landlord or local authorities. It's best to check with them directly to confirm.
  2. While having a physical office space is not a requirement for GST registration, you do need to have a valid place of business. If your landlord is unwilling to provide a NOC for you to use your home address, you may have to consider other options.

Another option is to register your business under the address of a friend or family member who is willing to provide a NOC.

I don't think I have any friend or family member who would be willing to do this. So it seems I cannot register for GST.

If any enquiry comes, can I tell the person that it's their system that did not allow me to register for GST so I'm not at fault here? And I'm willing to pay GST provided he/she helps me register for it first. 

I really think they should make it easier for people to register for GST!!

I already contacted around 5 professionals. This includes valiksearch, indiafilings, cleartax and a few independent CAs. All of there answers are inconsistent. Some say NOC is mandatory, some say it's not. 

If you are contacting forums then they hardly help in complicated matters.

Engage a professional, agree to a fee, explain the situation and give the registration work to that professional. You focus on your work and outsource this hassle

I understand, but I wish it were that easy. I already contacted a professional and paid advance fees too. The professional is asking me to get a NOC from the Landlord to proceed with the registration and the Landlord is refusing to give it. So that's the situation.

Tell your professional that NOC is not available. Ask him for alternative. If he cannot provide you with registration then take your money back and engage a different professional.

Pretty much the same as with doctors and other professionals although they don't give the fees back

As per the GST law and current registration guidelines, a freelancer can obtain GST registration using a residential address as the Principal Place of Business. There is no provision under the GST Act that automatically converts a residential property into a commercial property merely because GST registration has been obtained at that address.

However, where the premises are rented, the applicant is generally required to furnish valid proof of possession, such as a rent agreement along with the owner's consent/NOC, if sought by the GST authorities.

Therefore, the issue is not GST eligibility but the availability of acceptable address proof. If the landlord is unwilling to provide consent, you may consider using another eligible address, such as an owned property, a coworking space, or a virtual office that provides GST-compliant documentation.

In summary, a separate commercial office is not mandatory for GST registration; however, proper documentary evidence of the principal place of business is essential. - Setindiabiz
