GST Registration application pending after completion of 7 working days (10 days including holdiay)

Dear Experts,

After filing for new registration with Aadhar Authentication, state officer took 10 days to demand additional documents, no reason for dissatisfaction provided.

We filed the additional documents on 24th August, now after 10 days (7 working days), he personally called the business owner to visit the office (Which he cannot do as per my knowledge).

Officer failed to take any action within prescribed time limit, but no automatic provisional GST No. allotted. What can be done in this situation?

You’re right—according to GST law, the officer cannot ask the applicant to visit the office in person for registration after Aadhaar authentication, nor delay the process arbitrarily.

What the law says:

  • Time limit: Registration application is to be approved or rejected within 7 working days (excluding holidays) from the date of application or date of submission of additional documents.

  • If the officer fails to act within this time limit, the registration is deemed approved and the system should allot a provisional GSTIN automatically.

  • There is no provision for the officer to call the applicant personally to the office for registration post Aadhaar authentication and document submission.


What can be done now?

  1. File a grievance on the GST portal:

    • Visit the GST portal → Help & Support → Grievance → File a complaint against the delay.

  2. Approach higher authorities:

    • Write/email the Superintendent or Assistant Commissioner of your jurisdiction mentioning the delay and seeking urgent registration.

  3. RTI Application:

    • You can file an RTI to get status or reasons for delay if no response is received.

  4. Legal remedy:

    • Under Section 25(6) of the CGST Act, if no action is taken in 7 working days, registration shall be deemed approved.

    • You can send a legal notice to the department or approach the GST Appellate Authority if needed.


Summary:

  • The department is supposed to grant provisional registration automatically after 7 working days.

  • Calling the applicant personally is not permissible.

  • File grievance on the portal and escalate to senior officers.
