Good day all !

I have entered into a contract with builder for the construction of residential house in June 2017 at flat rate of 1500 per / ft

In July 2017 GST was introduced by Government. Although, the flat rate included taxes, He neither registered for GST nor paid any GST to Government or vendors to buy material for house and provided fake invoice in spite of doing business of more than 30 Lacs in 17 ~18 FY.

I want to lodge a complaint against the builder for tax evasion and want strict action taken against him. What is the best course of action ?

  2. File Complaint with GST Authorities:

    • You can file a complaint on the official GST portal:

      • Visit GST Complaint Portal

      • Navigate to “Complaints” section

      • Fill out the complaint form with all relevant details and evidence.

  3. Approach the Jurisdictional GST Office:

    • You may also directly visit or write to the GST officer (Assistant Commissioner or Deputy Commissioner) of the area where the builder operates.

    • Submit a written complaint with your evidence.

  4. Use Central Vigilance/CBIC Grievance Portals:

    • You can lodge complaints with the Central Board of Indirect Taxes and Customs (CBIC) through their grievance portal as well.

  5. Legal Action:

    • If you want stricter action, consult a tax lawyer for possible criminal proceedings or penalties under GST law.


Things to Keep in Mind:

  • The builder is required to register under GST if turnover exceeds ₹20 lakhs (₹10 lakhs in some states).
