GST Rate related to Food services by Restaurants

As per the Act and the new notification given the rate of GST is 5% with No ITC.

SO THERE ARE TWO QUERIES

1. What if I am taking ITC so what is the GST rate that I have to charge.

2. If I have not followed 5% with No ITC, then when can I start following the same. From Next month beginning transactions or from next Financial Year.

You cannot claim ITC .... in term of Notification 46/2017 CT(r) the Restaurant Service provider are not allowed to claim ITC , it's 5% without ITC.

Note
Only Restaurants in hotel where room tariff is 7500/- or more , need to charge 18% with full ITC
5% without ITC is for both Nomal Registered person and Composition Scheme Registered person also
